Terms of Use

The following are our terms and conditions, i.e. anyone attending our courses/workshops, coaching sessions and users of our website

General terms and conditions

  • If a participant is undergoing any medical treatment or has a physical or medical condition (including being on medication) that may affect their ability to participate on the chosen course or event, this must be brought to the attention of Climb in Flow staff prior to the start of the course or event. Climb in Flow staff reserve the right not to allow the participant to proceed with the course or event. If this happens, a refund will not be given.

  • Climb in Flow reserve the right to exclude any participant from an activity if their actions are thought to be endangering the safety of themselves or others. If this happens, a refund will not be given.

  • Any participant who acts in contravention of the decisions or advice of a Climb in Flow staff member or undertakes independent activities during the course or event will forfeit all professional protection and duty of care from Climb in Flow.

  • Personal belongings are the participant’s own responsibility. Climb in Flow do not accept responsibility for any loss of or damage to any personal belongings during Climb in Flow courses, workshops or face-to-face coaching.

  • Climb in Flow reserve the right to decline a booking or cancel an existing booking.

  • Climb in Flow owns all the media and photographs taken on an event unless agreed in advance. Photographs and media will be shared on Climb in Flow social media pages only.

  • Climb in Flow will not be held responsible for increased event costs due to Force Majeure. If an event is subject to an increase in price due to Force Majeure, that increase will be passed onto the participant or client.

  • Transfers of places between one participant and another is allowed. However, there will be a charge of 10% of the original cost with a minimum of £25 per person as an administration fee.

Becoming a student of any of our courses

  • When you (the client) “accept the Terms of Use and Privacy Policy" when you join any of our courses or personal coaching you acknowledge the terms and conditions as outlined herein, and agree and willingly purchase entry into our courses to be provided with services rendered by Climb in Flow, and you agree you are voluntarily entering into a legally binding agreement.

  • The client agrees and understands that he/she is purchasing a course, whether in person or online, that offers educational resources.

  • The client agrees to be bound by the terms and conditions outlined herein, as well as the general policies and procedures that can be found in this agreement, in the course and on our website.

  • Climb in Flow's educational resources, courses, workshops and coaching is not to be considered a substitute for personalized climbing instruction, sport psychology, medical, or safety advice. Climb in Flow's services are not designed to treat any mental, emotional, or other medical conditions. If you as the client believe you may be in need of personalized attention or therapy, whether for mental or physical health, or otherwise, please seek additional assistance outside Climb in Flow's services.

  • While many of Climb in Flow's (and affiliated people) past and current clients have experienced wonderful benefits from the content and coaching obtained through Climb in Flow, Climb in Flow cannot guarantee results from any of the content on in our courses, workshops and coaching cannot make any guarantees regarding individual results. The client will not hold Climb in Flow responsible if he or she does not experience the desired results.

  • The client also agrees to not hold Climb in Flow responsible should any physical, psychological, or any other injury occur as a direct or indirect result of Climb in Flow. The content provided by Climb in Flow’s website, courses, workshops and coaching is comprised of information that has worked for Climb in Flow’s coaches and other clients, and may or may not be useful to the client in his/her life. The client understands Climb in Flow cannot guarantee results from Climb in Flow's services, and has no expectation of a specific result that he or she holds Climb in Flow responsible for.

  • Client also understands he or she is purchasing the Climb in Flow services and participating freely and voluntarily. The information given by Climb in Flow may not be suitable for all persons and all climbing levels, and the client understands he or she may need to modify, edit, or change some of the educational resources within Climb in Flow’s webistes, courses, worshops and coachings in order to make it applicable to the client’s personal situation.

  • There is an inherent risk in all forms of climbing.

  • If you do the fall practice correctly you should be working towards reducing risk in climbing, however, accidents can always happen.

  • If you have any mental health disorders please consult with a mental health practitioner before taking part in this course.

Payment

  • The client understands that you can purchase Climb in Flow’s courses, workshops or coaching as a one-off payment. These prices are subject to change.

  • Client understands he/she is responsible for the full payment, and agrees to pay the sum requested electronically, via Woocommerce, Paypal, Stripe or BACS or another designated third-party payment processor, in full.

  • The price quoted is for the services, dates and times stated. Any changes to these requested by the client or participant may cause an increase in the price to be applied.

  • Full payment of the course fees, the workshop fees or coaching confirms the booking.

Refund Policy

  • Every attempt will be made by Climb in Flow to ensure that its courses, workshops and coaching sessions run.  However, should a cancellation be unavoidable then the participant(s) / client will be notified at the earliest opportunity

  • Should Climb in Flow cancel an event then the client shall be entitled to either a refund, minus costs incurred due to payment services used (i.e. Paypal, Woocommerce, Stripe, etc…) of the money paid or a transfer to an alternative date.

  • In the case of cancellation of a course due to unforeseen circumstances such as severe weather conditions, terrorist act, police incident etc then a full refund will be paid less actual costs incurred up to the point of cancellation.

  • All cancellations must be made in writing (email is acceptable providing an acknowledgment is received) to info@climbinflow.com

  • If, after booking, you need to change the dates of your course, we will offer you alternative dates, as long as you notify us at least 10 weeks prior to the starting date of the course you have booked. In other circumstances, we may exercise our discretion.

  • If you need to cancel with more than 10 weeks notice to the starting date of the course, the balance of your course fee (less admin fee of £25) will be refunded.

  • If you cancel with less than 10 weeks notice, we will only refund the balance of the fee (less the admin fee of £25) if we are able to re-sell the course space on your behalf. If we are unable to resell the course, the full course fee shall be charged.

  • Should the client wish to reschedule the course, and if Climb in Flow is able to accept the change, then an additional charge will be made which will be discussed and agreed at the time. This will be at least 30% of the total course cost.

Confidentiality

When the client purchases Climb in Flow’s courses, workshops or coaching, he or she will have gained access to various trade secrets, educational resources and intellectual property of Climb in Flow, including  verbal, written, audio and video advice, live coaching guidance, and/or other information available thorugh access to any Climb in Flow's services. The client understands and agrees that this information is not to be openly shared with others who have not purchased one of Climb in Flow’s courses, workshops or coaching sessions. The client agrees not to share, copy, or distribute any documents or other proprietary information obtained through Climb in Flow, and agrees that he or she will be in violation of these Terms of Use if he or she uses any of the content outlined as his/her own material, or repurposes and uses the content in his/her own business or coaching work without express written permission from Climb in Flow.

Should the client breach this provision and disclose confidential or proprietary information belonging to Climb in Flow, the client understands additional action may be taken by Climb in Flow up to and including legal action.

Intellectual Property

The client agrees and understands that Climb in Flow has created numerous original, creative works and agrees that Climb in Flow maintains all copyrights and other intellectual property rights in all original or derivative content associated with or included in all our courses, workshops, coaching and website, including but not limited to: documents, charts, emails, graphs, products, systems, processes, handouts, worksheets, videos, copy for website and any other original work created by Climb in Flow.

Nothing in this agreement shall constitute a transfer of ownership of any Intellectual Property from Climb in Flow to the client, nor grant any license to use the information in any way other than personal use.
